Terms and Conditions

General Terms and Conditions for the Navia app. As of October 26, 2026.

General Terms and Conditions

I. Scope

The mobile application "Navia" (hereinafter referred to as "App") is operated by AVIYA GmbH.

The following terms and conditions govern exclusively the contractual relationship between the user ("User") and AVIYA GmbH ("AVIYA") with regard to the booking of flights. The General Terms and Conditions of AVIYA GmbH also apply if the use, access, or booking takes place outside the Federal Republic of Germany.

II. Contractual Relationship

1. AVIYA provides the User with an APP through which flights are offered via a third-party provider https://duffel.com/, which acts as an agent for the respective airlines. The provision of the booked flight service as such is not part of AVIYA's obligations. Furthermore, AVIYA has no influence on whether the third-party provider or the airline accepts the User's contract offer. The "offers" displayed on Navia's APP are not binding contract offers.

2. When the User makes a booking via the APP, the booking is made directly with the respective airline. AVIYA is not a "contracting party" to the booking. By making a booking, the User concludes (i) an agency contract with the third-party provider (for the ticket) and (ii) a contract of carriage with the airline (for the flight itself). AVIYA expressly informs all Users that the contract is not concluded with AVIYA, but always with the third-party provider and the respective airline, taking into account their general terms and conditions. Their general terms and conditions become part of the contract between the User and the third-party provider or the respective airline upon booking.

3. If the User books extra services (such as additional baggage, insurance, check-in, etc.), the User enter into a contract directly with the third-party provider or another company. AVIYA is not involved in this contract.

4. AVIYA acts solely as the operator of the APP and is not involved in the terms and conditions of third parties. AVIYA is not responsible for the ticket or any extra services purchased by the User and is not liable (to the full extent permitted by law) to the User in relation to their booking.

5. Once the User has booked their flight, their booking information (e.g., the name(s) of the traveler(s)) is provided to the third-party provider. AVIYA uses the data provided in the context of a booking exclusively for the purpose of processing the booked services; further details on data protection can be found in the "Privacy Policy”.

6. The Navia app offers users an optional location feature to identify several nearby airports, search for flights from these airports, and handle location-based user requests, such as those regarding weather, directions, and travel times to airports. Location data is used exclusively for the location-based functions mentioned here. Access to the location only occurs after the user has given explicit consent through Apple’s standard permission prompt. The user can revoke the location permission at any time in their device settings. If the permission is not granted or is revoked, flights can still be searched and booked by manually entering the departure airport. Before searching, the user can select or change one of the suggested departure airports. For more information on the processing of location data, please refer to AVIYA’s privacy policy.

III. Liability of AVIYA and Limitations of Liability

1. Information regarding arranged flights is based exclusively on the information provided to AVIYA by third-party providers. It does not constitute any information or assurance provided by AVIYA to the User. AVIYA is not liable for the performance of services by third-party providers or airlines for flights selected by the User, but is only responsible for the proper transmission of the User's information provided during the booking process to the third-party provider. Liability to the User for the accuracy of the information provided by third-party providers is also excluded, unless AVIYA transmits this data incorrectly through gross negligence or intent.

2. The provision of flight services, which is the responsibility of the third-party provider or the respective airline, is not the subject of the contractual relationship with AVIYA. The third-party provider or the respective airline is solely liable for this. AVIYA is therefore not liable for services to be provided by third parties.

3. In the event of simple negligence, AVIYA shall only be liable to the User for damages incurred in connection with the booking in the APP, regardless of the legal basis, if an organ, employee, or vicarious agent of AVIYA has violated an essential contractual obligation. In this case, however, liability is limited to the typical damage incurred and is limited in amount to the price of the flight. AVIYA shall bear full liability in cases of intent and gross negligence.

IV. Booking Confirmation

1. The booking order placed by the User is only accepted by AVIYA at the point in time when the booking confirmation is displayed to the User in the APP. The User is obliged to review the booking confirmation immediately upon receipt and to notify AVIYA within 24 hours (in the case of short-term bookings, mandatorily before the start of the trip) of any discrepancies or incompleteness in comparison to the original booking order, including with regard to the exact name match. Deviations and incompleteness caused by the User and/or reported too late do not entitle the User to withdraw from the contract.

2. The User is required to check the contact details provided, especially the email address, in detail, as the airline's booking confirmation will be sent to these contact details. In this context, the spam/junk email folders should also be checked to see whether any relevant emails have been received there. This is the only way to ensure fast and smooth communication, especially for last-minute bookings.

3. Airlines reserve the right to change flight times at short notice. AVIYA will inform the User of any changes via the APP push notification.

In addition, the User is obliged to inform themselves of any changes to flight times at least 24 hours before the scheduled departure from the respective airline or airport. AVIYA is not liable for any disadvantages arising from the User's failure to comply with this obligation to inform themselves.

V. Prices and Payment

1. All flight bookings made with Navia must be paid for in advance. If a credit card or direct debit/SEPA is selected as the payment method, the User expressly authorizes AVIYA to collect the amount owed via the credit card number or to forward the relevant data to the third-party provider.

2. AVIYA charges a service fee for its services (booking portal, advice, check-in, rebookings, etc.) when booking. This fee is included in the final price as soon as it becomes unavoidable for the User in the booking process. It is then shown separately. The amount of the fee is based on the desired service and, in particular for air travel, on the route selection, the airline's fare, and the number of passengers to be transported.

3. The service fee charged by AVIYA represents remuneration for the agency and services provided by AVIYA and is not part of the flight price.

In the event of cancellation, withdrawal, or other termination of the contract of carriage by the user, the service fee is generally non-refundable, unless mandatory legal provisions dictate otherwise.

4. Technical payment processing is handled by external partner Stripe, 2010, San Francisco, California, United States.

5. In the event of a direct debit return caused by the User or other payment methods that have failed due to the User's fault, AVIYA may charge the User for the damage caused by the delay, cancellation costs, and the direct debit return costs incurred by the respective payment institution.

VI. Changes, Cancellations, and Refunds

1. The User may withdraw from the trip at any time prior to departure in accordance with the provisions of the contract concluded between them and the airline, whereby cancellation fees of up to 100% of the trip price may apply. Cancellation can be made either through AVIYA support or directly with the airline.

2. Any refund by the airline shall only apply to the flight price in accordance with the terms and conditions of the respective airline. The service fee charged by AVIYA remains unaffected by this.

3. Airlines reserve the right to postpone or cancel flights in accordance with the airline's terms and conditions, the contract of carriage, or the airline's guidelines.

4. Pursuant to Section 312g (2) No. 9 of the German Civil Code (BGB), the two-week right of return for distance contracts cannot be exercised in the case of transport services.

5. AVIYA cannot process change requests for rebookings or cancellations of certain services, such as low-cost flights. In such cases, the User must contact the respective airline directly.

VII. Obligations of the User

1. Defects in the booking must be reported to AVIYA immediately. AVIYA must be given the opportunity to remedy the situation. If such notification is culpably omitted, any claims arising from the contract in this respect shall lapse to the extent that reasonable remedy on the part of AVIYA would have been possible.

2. Navia cannot work with incorrect data. The User must ensure that all necessary information fields in the APP, in particular personal details and contact information, are filled in carefully and checked again. Incorrect data entered by the User, in particular email address, first and last name, can lead to difficulties in the execution of the contract, which can significantly impair the provision of services and cause additional costs.

VIII. Visa, Passport, Customs, Foreign Exchange, and Health Regulations

Each User is fundamentally responsible for ensuring that they meet the requirements necessary for the trip and that all legal provisions are observed, in particular domestic and foreign entry and exit regulations, health regulations, passport and visa regulations. The same applies to the procurement of necessary travel documents. The User must ensure that the names in their passport, visa, and other identification documents match exactly those in the booking. AVIYA expressly points out that the regulations may be changed by the authorities at any time. Users are therefore advised to obtain information from the relevant authorities and institutions themselves.

IX. Prohibition of Assignment

Any assignment of claims by the User against AVIYA, including to spouses or relatives, is excluded. The judicial assertion of the aforementioned claims by the User by third parties in their own name is also inadmissible.

X. Place of Jurisdiction and Applicable Law

If the User is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction shall be the state capital of Wiesbaden. For consumers, the statutory provisions on jurisdiction shall apply. The contractual relationships between the parties shall be governed by the laws of the Federal Republic of Germany, excluding the conflict of law provisions of the EGBGB.

XI. Dispute Resolution in accordance with the Consumer Dispute Resolution Act

In the event of disputes arising in connection with a booking made with Navia by a consumer within the framework of a contract, we would like to point out that we are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

XII. Final Provisions

1. These General Terms and Conditions are conclusive for the regulation of the legal relationship between AVIYA and the User. Amendments or additions to these General Terms and Conditions must be made in writing to be effective, as must their cancellation. AVIYA reserves the right to amend the General Terms and Conditions at any time in the future. The General Terms and Conditions valid at the time of conclusion of the contract shall apply.

2. Should any provision of these General Terms and Conditions or any part of such a provision be or become invalid, this shall not affect the validity of these General Terms and Conditions as a whole.

Privacy Policy

Privacy Policy of Aviya GmbH

This privacy policy informs you about how Aviya GmbH processes personal data in the "Navia" app (hereinafter referred to as "Navia" or "app"). The "Navia" app is operated by Aviya GmbH. It is aimed in particular at users in the EU/EEA and takes into account the requirements of the GDPR and the TTDSG.

1. Data Controller

Aviya GmbH ("Aviya," "we")

Senckenberganlage 19, 60325 Frankfurt am Main

Email: legal@aviyagmbh.com

Authorized representative: Tristan Reich

2. Data Protection Officer

We have not appointed a data protection officer at this time. You can contact us regarding data protection issues using the contact details provided in section 1.

3. Scope

This privacy policy applies to:

  • • the use of the „Navia“ App
  • • the functions offered in the App (e.g., user account, flight booking, transmission of data to airlines/service providers, customer support communication)

If you use third-party services via the App (e.g., flight booking, check-in, payments), the privacy policies of these third parties also apply.

4. Aviya's role in the booking process (important note)

Aviya provides an App through which flights are brokered or offered by third-party providers. Aviya is not a party to the contract of carriage; the contract for flight services is concluded between you and the respective airline (and, if applicable, the third-party provider acting as an agent). Aviya acts as the technical App operator and supports the processing (e.g., transmission of necessary data, display of booking information, push notifications).

5. Terms and legal basis

5.1 Personal data

"Personal data" is any information relating to an identified or identifiable natural person.

5.2 Legal bases

We only process personal data if there is a legal basis for doing so, in particular:

  • • Art. 6( 1) (a) GDPR – Consent (e.g. optional submission of certain data, consent to specific features, consent to receive marketing communications via email and/or SMS)
  • • Art. 6 (1) (b) GDPR – Contract performance (e.g., account, booking processing, support in connection with booked services)
  • • Art. 6 (1) (c) GDPR – Legal obligation (e.g., commercial/tax law retention)
  • • Art. 6 (1) (f) GDPR – Legitimate interests (e.g., IT security, fraud prevention, defense of legal claims)

If consent is required in connection with the use of technologies on your end device (e.g., for certain tracking/analysis technologies), this is done in accordance with the TTDSG.

6. What data we process (categories)

Depending on the use and functionality of the App, we process the following categories of personal data, among others.

6.1 Account data / Profile data

  • • Email address
  • • First name, last name
  • • Date of birth
  • • Gender (if requested/required)
  • • Phone number (optional/depending on the process; if marketing SMS are requested, also for sending marketing communications via SMS)
  • • Additional contact or address details (country, city, postal code, address), if required for the respective process

6.2 Data of travel partners (if provided by you)

If you add travel partners, we process (or have third parties process) their data such as:

  • • First name, last name
  • • Date of birth
  • • Gender
  • • Title (if necessary)

6.3 Travel documents

Depending on the requirements of the airline/check-in service, travel document data may be required, e.g.:

  • • Document type (e.g., passport/ID card)
  • • Document number
  • • Expiration date
  • • Issuing country

6.4 Booking and flight details

  • • Booking references (e.g., PNR)
  • • Departure/destination (codes)
  • • Flight number, airline (marketing/operating carrier)
  • • Travel dates (date/time)
  • • Seat information (if available in the process)

6.5 Payment and transaction data

Payment processing is carried out by external payment service providers (see section 8).

We do not store any complete payment/card data ourselves. Transaction/accounting data and external payment identifiers (e.g., from Stripe) may be processed in our systems.

6.6 Communication and support data

When you contact support or we contact you in connection with bookings:

  • • Content of your messages (e.g., support request)
  • • Metadata (time, communication channel)
  • • Booking reference (e.g., booking reference), if applicable

6.7 Usage and device data (App operation)

The following data may be processed for the technical operation of the App:

  • • Device information (e.g., operating system version, App version)
  • • Technical log data (e.g., error/crash logs, if implemented)
  • • Timestamps of actions in the App (e.g., login, start of booking).

6.8 Camera and Voice Data

The app accesses certain device-specific functions only after you have given your prior explicit consent. Processing is carried out in accordance with applicable data protection regulations, in particular the General Data Protection Regulation (GDPR).

  • • Camera:

Access to the camera is used exclusively for capturing travel documents (e.g., passport or ID card) within the app. The scanning function used for this purpose was developed in-house. The captured document data is processed exclusively in encrypted form. Photos or image files are never stored.

  • • Microphone / Speech Recognition:

Access to microphone and speech recognition functions is used exclusively for voice input (speech-to-text) within the app, for example, to search for flights. Speech recognition is provided via the native Apple framework “SFSpeechRecognizer.” We do not create any audio recordings ourselves and do not store any speech data.

6.9 Marketing Consent Data

If you have consented to receive marketing communications, we process the following data:

  • • Selected communication channel (email, SMS, or both)
  • • Date/time and content of the consent
  • • Withdrawal status

Legal basis: Art. 6 (1) (a) GDPR. Consent may be withdrawn at any time with effect for the future.

6.10 Location Data

When you enable the location feature and grant location permission, the app may process location data or the current location of your device. This processing is carried out exclusively for the following purposes:

  • - Automatically determining several nearby airports
  • - Suggesting these airports as possible departure airports
  • - Searching for flights departing from the suggested airports
  • - Handling other location-based user requests, for example regarding local weather, directions, and travel times to airports.

The location feature is optional. Location data is not used for personalized advertising, tracking, or any purposes other than those listed above. Access occurs only if you have granted the corresponding permission through Apple’s standard permission prompt. You can revoke the permission at any time in your device settings. If you decline or revoke the permission, you can still enter the departure airport manually.

Before starting a flight search, you can select or change one of the suggested airports. Location data is processed only for as long as is necessary for the respective location query and for carrying out the specific location-based function requested. The exact location history is not stored permanently.

7. Purposes of processing

We process data for the following purposes in particular:

1. Provision and operation of the App (technical delivery, stability, security)

2. Creation and management of a user account

3. Initiation and processing of bookings (transfer of necessary data to intermediaries/airlines)

4. Provision of check-in/travel services (if used)

5. Payment processing (via payment service providers)

6. Customer service and communication regarding bookings and changes

7. Fulfillment of legal obligations (e.g., accounting, storage)

8. Prevention of abuse and fraud, IT security, assertion/defense of claims.

9. Sending marketing communications via email and/or SMS exclusively on the basis of prior explicit consent (Art. 6 (1) (a) GDPR). Consent may be withdrawn at any time.

8. Recipients of data / third-party providers

We only pass on personal data if this is necessary (e.g. for booking processing) or if you have given your consent.

8.1 Flight brokerage/booking processing

Duffel (flight brokerage/technology partner)

When making a booking, data (e.g., name, contact details, date of birth, travel document details, booking details) may be transferred to Duffel so that the booking can be technically processed or forwarded to the respective airline.

8.2 Airlines

In order to execute the contract of carriage, the necessary data is transmitted to the respective airline (e.g., name, date of birth, travel document data, booking data).

8.3 Check-in / Travel Services

If you use check-in services, the necessary data (e.g., names, booking/flight data, travel document data) may be transferred to Checkin.

8.4 Payment processing

Stripe (payment service provider)

Payment data is transmitted to Stripe for processing.

Important: Our systems regularly store only transaction data and external identifiers (e.g., a Stripe transaction ID), but not complete card/account data.

8.5 Processors

In addition, technical service providers (e.g., hosting, IT operations, support tools) may be used as processors. These processors only process data in accordance with our instructions and on the basis of a contract in accordance with Art. 28 GDPR.

9. Tracking, analytics, advertising (App Store relevant information)

9.1 "Tracking" as defined by Apple/App Store

Apple defines "tracking" as linking user data (e.g., device ID) across third-party apps/websites for advertising purposes or sharing such data with data brokers.

  • • Tracking for personalized advertising: [NO]

9.2 Analytics/performance tools

We currently do not use any separate third-party analytics or tracking SDKs that go beyond what is necessary for the operation of the App.

10. App permissions

Depending on the range of functions, the App may request permissions. Processing will only take place if you grant the respective permission, e.g., for push notifications relating to booking or flight changes and service messages; if corresponding consent has been provided, also for sending marketing communications via email and/or SMS.

11. Data transfer to third countries

If recipients (e.g., Stripe or subcontractors) process personal data outside the EU/EEA, we ensure that an adequate level of data protection is in place, e.g., through:

  • • EU Commission adequacy decisions, or
  • • EU Standard Contractual Clauses (SCC), supplemented by additional measures where necessary.

12. Storage period, deletion, and anonymization

We only store personal data for as long as is necessary for the purposes for which it was collected or for as long as there are legal retention obligations.

12.1 General principles

  • • Data from contract/contract initiation: Storage for the duration of the contractual relationship and beyond, if necessary
  • • Statutory retention obligations: e.g., commercial and tax law deadlines
  • • Enforcement of rights: storage for the assertion/defense of claims (statutes of limitations)

12.2 Deletion upon account deletion

If you delete your account:

  • • profile data will generally be deleted or anonymized, unless there are any retention obligations that prevent this
  • • certain data may remain in anonymized form (e.g., only year of birth instead of date of birth) or as verification and accounting data

12.3 Payments and Stripe identifiers (e.g., payment_intent_id)

For the traceability of payment processes (e.g., chargebacks, accounting, documentation requirements), it may be necessary to retain transaction data and external payment identifiers (e.g., Stripe payment_intent_id) even after an account has been deleted.

  • • The legal basis for this is Art. 6 (1) (c) GDPR (legal obligation) and/or Art. 6 (1) (f) GDPR (legitimate interest in proof/defense).
  • • Where possible, we only store the minimum data required (data minimization).

13. Security of processing

We use appropriate technical and organizational measures (TOM) to protect your data, in particular against loss, manipulation, or unauthorized access. These may include, among other things:

  • • Access controls and authorization concepts
  • • Transport encryption (e.g., TLS)
  • • Logging and monitoring of security-related events
  • • Data minimization and pseudonymization/anonymization, where appropriate

14. Automated decisions/profiling

Automated decision-making within the meaning of Art. 22 GDPR does not take place as a matter of principle.

15. Your rights

You have the following rights, provided that the legal requirements are met:

  • • Access (Art. 15 GDPR)
  • • Rectification (Art. 16 GDPR)
  • • Erasure (Art. 17 GDPR)
  • • Restriction of processing (Art. 18 GDPR)
  • • Data portability (Art. 20 GDPR)
  • • Objection to processing based on legitimate interests (Art. 21 GDPR)
  • • Withdrawal of consent with effect for the future (Art. 7 (3) GDPR)

To exercise your rights, please contact us using the details provided in section 1.

15.1 Identity verification

To prevent misuse, we may ask you for information that enables us to identify you before we provide information or disclose data.

16. Right to lodge a complaint with a supervisory authority

You have the right to lodge a complaint with a data protection supervisory authority, in particular in the Member State of your habitual residence, your place of work, or the place of the alleged infringement.

17. Data of minors

The App is not intended for children under the age of 18. If you believe that we are processing a child's data without the required consent, please contact us so that we can investigate and delete it if necessary.

18. Changes to this privacy policy

We may update this privacy policy, e.g., in the event of changes to the App's functions or the legal situation. We will provide the current version in the App.

Terms and Conditions

General Terms and Conditions

I. Scope

The mobile application "Navia" (hereinafter referred to as "App") is operated by AVIYA GmbH.

The following terms and conditions govern exclusively the contractual relationship between the user ("User") and AVIYA GmbH ("AVIYA") with regard to the booking of flights. The General Terms and Conditions of AVIYA GmbH also apply if the use, access, or booking takes place outside the Federal Republic of Germany.
